An agent who collects money from an insured and holds it for payment to the insurer is acting in a fiduciary capacity. A fiduciary must hold and handle funds for the benefit of the party entitled to them, not for the agent’s personal use. Wrongfully withholding funds would occur if the agent failed to remit or misused the money. Commingling would occur if the agent mixed fiduciary funds with personal or operating funds improperly. Collecting premium or escrow-related money also does not itself provide coverage; coverage arises from the insurance contract and insurer authority. Pennsylvania title agency law specifically requires title agents to collect and hold funds due the title insurer in a fiduciary capacity in appropriate accounts.

A closing protection letter protects a covered party against certain losses caused by the title insurer’s issuing agent or approved attorney in connection with the closing. The escrow or closing agent is the party whose misconduct or failure to follow written closing instructions may trigger the CPL protection; that agent is not the protected party under the letter. The Pennsylvania TIRBOP/ALTA CPL form identifies the protection as indemnity for the addressee’s actual loss of funds and ties eligibility to the lender or purchaser/lessee role in the transaction. An acknowledgment is a notarial act in which the signer personally appears before the notary and acknowledges that the signature on the record is his or her own. It does not verify that the contents of the deed are true. It is not itself the authorization to convey property; the deed and the grantor’s legal capacity accomplish that. It is also not simply a signature on a deed. The acknowledgment provides evidence of proper execution and supports recordability of the instrument. This matters in title insurance because a defective acknowledgment can create a recording or title problem. Pennsylvania’s Department of State explains that a person may sign in the notary’s presence or acknowledge that the signature on the document is his or her own.

Charging a higher premium because of race, marital status, or age is unfair discrimination. Rebating means giving something of value or returning part of the premium as an inducement not stated in the policy. Illegal inducement is similar to rebating but focuses on improper incentives to purchase insurance. Coercion involves forcing or pressuring someone into an insurance transaction. Here, the improper conduct is rating or underwriting discrimination based on protected or impermissible classifications rather than risk-based underwriting. Pennsylvania’s Unfair Insurance Practices Act identifies unfair discrimination in rates, benefits, terms, conditions, underwriting standards, and eligibility rules, including discrimination by reason of race, age, sex, place of residence, or marital status.
