Massachusetts real estate law requires licensees to notify the Board of Registration of Real Estate Brokers and Salespersons of any changes that affect their license status or operations. This includes:

Change of mailing address (M.G.L. c. 112, § 87YY).

Change of broker affiliation for salespersons.

Operating under a trade name (which requires Board approval and proper business certificates).

However, a broker who conducts business under their own legal name does not need to notify the Board separately of this fact. The license is already issued in the broker’s name, so no additional approval is required unless a trade or business name is used.

The correct answer is B, a properly designated escrow account. Massachusetts imposes strict rules on the handling of transaction funds belonging to others.

A broker who receives deposits in connection with a transaction generally must place them in an appropriately established escrow account unless the parties have made another legally valid written arrangement. The money must remain separate from the broker ' s personal or operating funds.

Placing client money into the brokerage ' s ordinary operating account creates improper commingling. Using the money for the broker ' s personal or business purposes can constitute the much more serious act of conversion.

A salesperson who receives deposit money does not maintain an independent escrow account; the salesperson must promptly transmit the funds to the responsible employing broker for lawful handling.

The ultimate right to the money depends on the contract and outcome of the transaction. Deposit funds do not automatically become the seller ' s property merely because an offer was accepted.

A Massachusetts listing contract may be oral, making B correct. The Massachusetts Board ' s current Contract Law curriculum expressly identifies listing agreements as employment contracts and states that they may be in writing or oral.

The other choices implicate Massachusetts Statute of Frauds requirements. An agreement for the purchase and sale of real estate must generally be evidenced by a sufficient signed writing to be enforceable against the party to be charged. Likewise, an agreement that by its terms cannot be performed within one year falls within the Statute of Frauds; a twenty-year lease therefore cannot rely on a bare oral agreement for ordinary enforceability.

This does not mean oral listing agreements are good brokerage practice. Written agreements provide much stronger evidence concerning price, term, commission, scope of authority, agency relationship, and other duties. Certain brokerage or consumer disclosures also have independent statutory or regulatory requirements and must not be confused with whether the underlying listing employment agreement can technically be oral.

For exam purposes, the Massachusetts-specific rule is clear: listing agreement = potentially oral; purchase/sale of real estate = writing required for enforceability.

Tenancy by the entirety is a special form of ownership available only to married couples in Massachusetts. It provides rights of survivorship and protection from individual creditors of one spouse.

Upon divorce, the law automatically converts a tenancy by the entirety into a tenancy in common, unless otherwise stated in the divorce decree. In tenancy in common, each former spouse owns an undivided share of the property without survivorship rights, and they are free to transfer or sell their interest independently.

It does not convert into joint tenancy or tenancy in severalty unless agreed to or ordered by the court.
